3. Required Elements of a Formal Notice (17 U.S.C. § 512(c)(3))
To be effective under federal law, your written notification must include substantially the following information:
- Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

5. Counter-Notification Protocol (17 U.S.C. § 512(g)(3))
If material you posted was removed or disabled as a result of a DMCA notice and you believe such removal was due to a mistake or misidentification (such as licensed syndication rights or fair use), you may submit a formal Counter-Notification to our Designated Agent.
The counter-notice must contain:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled, and the location where the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or federal court in the jurisdiction where DexxiGirl is located if outside the United States), and that you will accept service of process from the person who provided the original DMCA notification.
Upon receipt of a valid counter-notice, DexxiGirl will forward it to the original complaining party. If the complaining party does not file a court action seeking a restraining order within ten (10) to fourteen (14) business days, DexxiGirl may restore the material in accordance with federal law.
6. Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i)(1)(A), DexxiGirl maintains a strict repeat infringer policy. We will terminate, under appropriate circumstances and at our sole discretion, the accounts and publisher privileges of creators, producers, or users who are determined to be repeat infringers of intellectual property rights.
7. Statutory Damages for False or Bad-Faith Claims
